denying the state, the judge said backers failed to show they would succeed on appeal. first because the minimal evidence does not support the defense and second because they may have no legal standing to appeal. and allowing same sex marriage to marry would be lawful. another reason he sited against it was that it would force california to continue to violate plaintiff's constitutional rights. he discounted the argument that a stay was in the public interest. and evidence during the trial showing it is proposition 8 that harms the state of california.
while his ruling is a victory for same sex couples, it does not let them get married right away. in san francisco, dan, kron 4 news. supporters of proposition 8 filed an appeal to stop gay marriages while the court considers the ruling. the supporters released a statement on the legal process. that statement says throwing out the voters passage of prop 8 this early shows the court is determined to impose the same- sex marriage whether we like it or not. we asked supporters who were picketing what they thought. >> i would hope for a intervention to override his decision about the stay and decide the issue of the
constitutionality. >> i am glad he allowed some time to appeal so he doesn't do what they did last year and muddy the waters by having these same-sex marriages and not knowing what to do when the people decided against it. >> do the backers have a legitimate case? we asked julie her opinion. here is what she had to say. >> if they decide they have no standings, the backers could appeal that. however, they have two problems, the court is very strict on standing requirements and also the united states supreme court previously expressed in another case its opinion that the backers do not have standing to defend the
constitutionality of that. and that means they are not likely to bail out the backers of prop 8. >> the anticipation is building for many same sex couples who want to get married. kron 4's reggie is live in san francisco for reaction. reggie? >> reporter: looks like a typical night here. not very many people out in the streets as you can see. many are probably staying away until next wednesday because the stay has been extended. i spoke with a couple earlier today who is already making wedding preparations. they have been waiting to marry for 20 years. both are hoping to take the plunge after next wednesday. >> we have been waiting for so long that i think waiting
another 7 days is not going to make a difference. >> this is a day we have been waiting for for a long time. it's very exciting. we plan to get our license and we will wait. >> reporter: many feel the same way and home same sex couples will once again tie the not. he remembers that day all too well. >> i saw couples lined up out the doors in city hall, full of happy couples. when that was taken away it was upsetting. >> there is always niches. initially you have to wait on that. hopefully it will be -- it's

small animals. kron 4's jonathan was in the room when they battled it out. >> reporter: pet stores without the pets. want to buy a bird? not in san francisco. they are proposing banning the sale of all small animals. >> to me selling animals while adoptable animals are being euthanized is an embarrassment. >> reporter: shelters and rescues are overcrowded with pets that people bought on a impulse. >> the ban on sales won't address the problem because there is nothing to change the consumer's behavior. >> reporter: one possible

we are seeing dense fog close to the coast. that was is going to continue. drizzle close to the coast. temperatures are going to stay on the mild side. for the weekend we will see a big warm up into early next week. first, let's look at fog. 6:00 a.m., patchy fog along the delta. same for the inland spots. fog reaching pleasantten and clearing back. 9:00 a.m., the bay seeing fog and the coast line the fog moving back. by the early afternoon we will see some fog over san francisco. lookt @ the sun breaks in the north bay coast. still, the fog lingers over the beach, those spots stay under the clouds. temperatures for tomorrow.

previous women. dna will determine if they are looking for multiple suspects or is it the same man. >> reporter: san jose five men in custody in connection with a armed robbery. police say tuesday afternoon two of the five suspects entered the store and demanded cash. one person pulled a gone and shot one of the clerks. suspects made off with cash. the other clerk called police, police caught up with the suspect vehicle where all five were taken into custody. >> reporter: oakland, bart has a $4 million surplus, might have double that by the end of the year. the board listened to the public and dropped the idea of lowering fairs for a few
